一．            聘請_____________國____   籍_________________女士(先生)為英語教師。雙方本著友好合作精神，自愿簽訂本合同并保證認(rèn)真履行合同中約定的各項義務(wù)。

五．聘方的義務(wù)：

2．對受聘方的工作進行指導(dǎo)、檢查和評估。

3．向受聘方提供必要的工作和生活條件。

4．配備合作共事人員。

5．按時支付受聘方的報酬。

六．受聘方的義務(wù)：

1．遵守中國的法律、法規(guī)，不干涉中國內(nèi)部事務(wù)。

2．遵守聘方的工作制度有關(guān)外國專家的管理規(guī)定，接受聘方的工作安排、業(yè)務(wù)指導(dǎo)、檢查和評估。未經(jīng)聘方同意，不得兼任與聘方無關(guān)的其它勞務(wù)。

3．按期完成工作任務(wù)，保證工作質(zhì)量。

4．尊重中國的宗教政策。不從事與專家身份不符的活動。

5．尊重中國人民的道德規(guī)范和風(fēng)俗習(xí)慣。

6．受聘方每周工作    課時。

七．合同的變更、解除和終止：

1．雙方應(yīng)信守合同，未經(jīng)雙方一致同意，任何一方不得擅自更改、解除和終止合同。

2．經(jīng)當(dāng)事人雙方協(xié)商同意后，可以變更、解除和終止合同。

3．聘方在下述條件下，有權(quán)以書面形式通知受聘方解除合同：

（1）受聘方不履行合同或者履行合同義務(wù)不符合約定條件，經(jīng)聘方指出后，仍不改正的；

（2）根據(jù)醫(yī)生診斷，受聘方在病假連續(xù)30天后不能恢復(fù)正常工作的。

4．受聘方在下述情況下，有權(quán)以書面形式通知聘方解除合同：

（1）聘方未按合同約定提供受聘方必要的工作和生活條件；

（2）聘方未按時支付受聘方報酬。

八．違約金：

當(dāng)事人一方不履行合同或者履行合同義務(wù)不符合約定條件，即違反合同時，應(yīng)當(dāng)向另一方支付500—2000美元（或相當(dāng)數(shù)額的人民幣）的違約金。受聘方因不可抗力事件要求解除合同，需出具有關(guān)機構(gòu)證明，經(jīng)聘方同意后，離華的費用自理；受聘方若無故解除合同，除離華的費用自理外，還應(yīng)當(dāng)向聘方支付違約金。

九．本合同附件為合同不可分割的一部分，與合同具有同等效力。

十．本合同自雙方簽字之日生效，合同期滿自行失效。當(dāng)事人一方要求簽訂新合同，必須在本合同期滿90天前向另一方提出，經(jīng)雙方協(xié)商同意后簽訂新合同。

十一.仲裁

當(dāng)事人雙方發(fā)生合同糾紛時，盡可能通過協(xié)商或者調(diào)解解決。若協(xié)商、調(diào)解無效，可向外國專家局設(shè)立的外國文教專家事務(wù)仲裁機構(gòu)申請仲裁。

V. Party A’s Obligations

1.      Party A shall introduce to Party B the laws, decrees and relevant regulations enacted by the Chinese government, the Party A’s work system and regulations concerning administration of foreign experts.

2.      Party A shall conduct direction, supervision and evaluation of Party B’s work.

3.      Party A shall provide Party B necessary working and living conditions.

4.      Party A shall provide co-workers.

5.      Party A shall pay Party B’s salary regularly by the month.

VI. Party B’s Obligations

1. Party B shall observe the laws , decrees and relevant regulations enacted by the Chinese government and shall not interfere inChina’s internal affairs .

2. Party B shall observe Party A’s work system and regulations concerning administration of foreign experts and shall accept Party A’s arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A’s consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.

3. Party B shall complete the tasks agreed on schedule and guarantee the quality of work.

4. Party B shall respectChina’s religious policy, and shall not conduct religious activities incompatible with the status of an expert.

5. Party B shall respect the Chinese people’s moral standards and customs.

6. Party B shall work     classes every week.

VII. Revision, Cancellation and Termination of the Contract

1. Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.

2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.

3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:

(1)   Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.

(2)   According to the doctor’s diagnosis, Party B cannot resume normal work after a continued 30 day sick leave.

4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions:

(1)   Party A has not provided Party B with necessary working and living conditions as stipulated in the contract.

(2)   Party A has not paid Party B as scheduled.

VIII. Breach PENALTY

When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US $500 to 2,000(or the equivalent in RMB).

If Party B asks to cancel the contract due to events beyond control, or should produce certifications by the department concerned, obtain Party A’s consent, and pay its own return expenses and pay a breach penalty to Party A.

If Party A asks to cancel the contract due to events beyond control , with the consent of Party B, or should pay Party B’s return expenses; if Party A cancels the contract without valid reason, it should pay Party B’s return expenses and pay a breach penalty to Party B.

IX. The appendix of this contract is an inseparable part of the contract and has equal effect.

X. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two will automatically expire when the contract, it should forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent.

   Party B shall bear all expenses incurred when staying on after the contract expires.

XI .Arbitration

The two parties shall consult with each other and mediate any disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of Foreign Experts and ask for a final arbitration.

一、受聘方的教學(xué)任務(wù)是給在校學(xué)生授課，講課英語包括聽、說、讀 、寫。

       A.每周工作日為五天。周六、周日休息。

B.每周課堂教學(xué)     課時以內(nèi)，每超課時付外教      元。

二、合同期間，甲方承擔(dān)下列義務(wù)：

       A.為受聘方提供月薪    元稅前（人民幣）,將于每月    日前發(fā)放。

       B.為受聘方免費提供住房一套（配有廚房、衛(wèi)生間、家具、臥具、電話、電視機、電腦、打印機、電冰箱、微波爐、洗衣機）。

C.受聘方完成合同項目后，為他提供機票補助     元。如果受聘方不完成合同項目，將擔(dān)負(fù)自己的往返機票費用。

D.受聘方享有人民幣      元的休假補貼費。

E.合同期內(nèi)學(xué)校為受聘方購買在華大病和意外保險。

三、受聘方患病休假憑醫(yī)院證明向校方請假，受聘方在病假連續(xù)30天后不能恢復(fù)正常工作，聘方將安排其回國，回國費用自理。受聘方請事假，經(jīng)學(xué)校同意后，按日扣發(fā)工資，在合同期一年內(nèi)，事假累計不得超過十天，未經(jīng)聘方同意而擅離職守，曠工一天，扣發(fā)兩天薪金。

Attachment

1.  Party B’s responsibilities are to teach medical students, teachers and doctors. Teaching English includes speaking, listening, reading and writing.

    A. Party B shall work 5 days a week. There are 2 days rest on Saturday and Sunday.

B. Party B shall teach within    classes a week. (     RMB will be paid per extra teaching hour.)

2.        During the term of service, Party B shall be provided with the following:

A. Party B shall be provided a monthly salary of        Yuan (RMB) before tax, and will be paid before the        of each month.

B. Party B shall be provided with an apartment free of charge, furnished with, bedding, a bathroom, a television set, a computer, a printer, a telephone, a refrigerator, microwave oven, a washing machine and a kitchen.

    C. Party B shall be provided for       RMB as airline ticket allowance after complete the contract. In case Party B fail to fulfill the contracted term of service, Party B would have to pay for his/her round-trip airline ticket and other expenses that Party A has already paid for him / her.

    D. Party B shall receive a vacation allowance of       Yuan (RMB).

    E. Party A will offer Party B the medical and accident insurance during the contract term.

3.  If Party B is ill, he/she shall ask for sick leave and produce a doctor’s certificate. When Party B cannot resume normal work after a continued 30 days of sick leave and according to the doctor’s diagnosis, Party A shall arrange for him/her to return home. In such case, Party B shall pay for the expenses involved in traveling back home. If Party B asks for a leave of absence and obtains the university’s consent, deduction in salary shall be made according to the number of days of such absence, which shall not exceed 10 days during the term of service. A double deduction in salary shall be made for absence without the university’s consent.
